A group of lawyers of LexProf won a favorable decision in the lawsuit that at the time of its consideration was the highest amount lawsuit in the Arbitration Court of the Novosibirsk region.
The complexity of the case was that damages claimed from the tenant were related to the loss of the aircraft in service, whose owner, at the time of the air crash, was not included as an owner in the State Register of Aircrafts. Thus, even before the formation of the evidence base, a question connected with the uncertainty of the plaintiff's personality had arisen.
All practicing lawyers know the complexity of proving a set of all elements of damages. However, the peculiarity of this case was that, in addition to the real damage, the lost profit was also collected in the amount of the average income of the letter received from the leased property use before its loss.
